Terms & Conditions

The Nando’s PERi-PERi Promotion (the “Promotion”) is operated by Nando’s Grocery International Ltd., with offices at 1800 Autoroute Laval, Laval, Quebec, Canada, H7S 2E7 (the “Promoter”). The Promoter’s headquarters are located at St. Mary’s House, 42 Vicarage Cres, Battersea, London, UK SW11 3LD.

Promotion Summary:

Nando’s are looking to give you the opportunity to win either a PERi-mazing experience (as described herein), a bottle of PERinaise in an available flavour of your choice, or $2 off your next purchase of PERinaise (each a “Prize”). All you need to do is visit nandos.ca/peri-mazing to enter the Promotion in accordance with these terms and conditions (the “Terms”).

We have 3 prize tiers: 5 winners will each win a PERi-mazing Experience, each with an approximate retail value of $800 (CAD) (“Tier 1 Prize”), 376 winners will each win a bottle of their choice of available flavours of PERinaise, approximate retail value of $6 (CAD) (“Tier 2 Prize”), and 4600 winners will each win $2 off their next PERinaise purchase (“Tier 3 Prize”). Odds of winning will depend on the number of eligible entries received during the Promotion Period.

Official Rules

NO PURCHASE IS NECESSARY TO ENTER THE PROMOTION. THE PROMOTION IS VALID IN CANADA ONLY AND IS OPEN ONLY TO ELIGIBLE PERSONS, AS SPECIFIED IN THE TERMS BELOW. ALL FEDERAL, PROVINCIAL, LOCAL, AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED

These Terms prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry instructions are deemed to form part of the Terms, and by participating in the Promotion, all participants will be deemed to have accepted and agreed to be bound by these Terms. Winning a prize is contingent on being compliant with these Terms, as determined by Promoter in its sole discretion. Please retain a copy of these Terms for your information.

By entering the Promotion and submitting an entry and any other personal information, entrants are expressly consenting to the collection, use, disclosure and other processing of their personal information by the Promoter for the purposes of the Promotion as described in these Terms and as set out in clause 1(d) or any associated publicity by the Promoter without further notice or compensation, and in accordance with Promoter’s privacy policy (available at https://www.nandos.ca/privacy-policy). From time to time, the Promoter may share entrants’ personal information with their agents/representatives to assist with administering the Promotion, contacting entrants and prize fulfilment (as necessary). Entrants acknowledge and agree that the Promoter may publicly announce the name of the winners within 30 days of the close of the Promotion, on winners list and in print or digital promotional materials, including through the Promoter’s official social media channels. This section does not limit any other consent(s) that an individual may provide the Promoter in relation to the collection, use and/or disclosure of their personal information. Promoter may also disclose entrants’ personal information if required to do so by applicable law. Please note that personal information provided as part of the Promotion may be collected in, transferred to and processed and stored in jurisdictions outside of Canada. Such information will be subject to the general laws applicable within those jurisdictions, including, without limitation, possible access by regulatory authorities. The Promotion is only open to Canadian residents who are the age of majority in their province or territory of residence at the time of entry (each, an “entrant”), excluding: (i) current and former directors, officers and employees of Promoter (and its parents, subsidiaries, franchisees, or affiliates) and their respective relatives, agents and/or representatives, (ii) any person with whom such persons are living, whether related or not, and (iii) any entity involved in the development, production, administration, judgment or fulfillment of the Promotion and any person with whom such persons are living, whether related or not.

1. HOW TO TAKE PART

No Purchase Necessary. Internet access and a valid email account are required. In order to take part in the Promotion, entrants must follow the steps noted below during the Promotion Period (as defined below):

a) Follow the URL directly to the promotional website ‘www.nandos.ca/peri-mazing’

AND

Once on the promotional website, the entrants must play the ‘tap to release the Perinaise’ game;

AND

b) Answer a mathematical skill testing question (the “Skill Testing Question”) correctly;

AND

c) fill in the following details to enter the Promotion:

  • - Full Name;
  • - Email Address;
  • - Phone Number;

(collectively the “Entry Materials”).

Receipt of an Internet entry occurs when the Promoter's server records the Entry Materials. All entries are subject to verification by the Promoter, in its sole discretion. Eligible entries received during the Promotion Period will receive one (1) entry in the Promotion. Maximum one (1) entry per person.

2. PRIZES

There will be a total of 4,981 Prizes awarded after the end of the Promotion Period. The Prizes are separated into the following three Tiers:

Tier 1 Prize: 5 prizes of a PERI-mazing Experience. Winners have a choice, Subject to availability of one of the following experiences with an estimated retail value of $800 (CAD).

  • a) Supercar Experience
  • b) Off-road Snowshoe adventure
  • c) Cowboy Experience
  • d) White Water Rafting
  • e) Whale Watching
  • f) River Kayaking
  • g) Tandem Skydive
  • h) Nordic Spa Experience;

Tier 2 Prize: 376 prizes of 1 x coupon for a free bottle of any available flavour/size PERinaise valid for two weeks from download via a link to be provided via email;

Tier 3 Prize: 4600 prizes of $2(CAD) off a bottle of PERinaise voucher, valid for one month from download via a link to be provided via email;

The total aggregate value of prizes available to be won in this Promotion is approximately $15,400 (CAD).

3. PRIZE DETAILS & CONDITIONS

a) Tier 1 Prizes are subject to availability.

b) Winner is solely responsible for any and all federal, provincial, and local taxes. By entering this Promotion Prize winner acknowledges and understands that inherent risks involved in group activities may be present. All details of the Tier 1 Prize event, including but not limited to date, time, location, number of attendees and activities will be communicated to winners, but will ultimately be determined at the sole discretion of Promoter.

c) Winner must abide by any relevant terms and conditions which form part of the Tier 1 Prize.

d) The winner is responsible for the behaviour of themselves and their guests whilst taking part in the Tier 1 Prize. The Promoter reserves the right in its sole and absolute discretion to exclude the winner and/or their guests from participation in any aspect of the Prize at any point if any party fails to comply with the directions of the Promoter or any companies associated with the Prize or if the winner and/or their guests act in a manner that is dangerous to themselves or to the public or is, in the opinion of the Promoter, causes a disturbance or nuisance to others, or reflects unfavourably on the goodwill and reputation of the Promoter.

4. WINNER SELECTION

All valid entrants who correctly answer the Skill Testing Question will be awarded a prize while supplies last. Prizes will be awarded by the Promoter’s computer software via an algorithm process which will award a Tier 1, Tier 2 or Tier 3 prize at random immediately each time a valid entry is recorded.

Subject to early termination by the Promoter, for any reason, and subject only the jurisdiction of the Régie des alcools, des courses et des jeux (the “Régie”) in Quebec, participants will be able to enter between midnight EDT on May 10, 2021 and midnight EDT on June 6, 2021 (the “Promotion Period”). No entries will be accepted before or after the Promotion Period. Entries that are submitted before or after the Promotion Period will be automatically disqualified. The Promoter’s computer is the official timekeeping device for the Promotion.

Potential winners will be contacted one (1) time via email to organize receipt of their Prize on or before 20th June 2021 (the “Notice”) Potential winners will be required to confirm acceptance of their Prize, and provide their address for shipment of the Prize within seven (7) days of Notice receipt. Potential winners of Tier 1 Prizes will also be required to return a signed copy of the Release Form within such seven (7) day period. If a potential winner (i) cannot be contacted (including if the notification is returned as undeliverable or fails to reach the potential winner for any other reason), (ii) fails to respond to the Notice or fails to submit any required documents, information and/or comply with the Terms within the required time period, the potential winner will be deemed to have forfeited their claim for a Prize. If a potential winner is unable to receive or redeem a Prize (or a component thereof) or to complete any of the steps contemplated in this section due to reasons beyond the reasonable control of the Promoter, no compensation or substitute Prize will be provided to such potential winner.

The Promoter reserves the right to select alternate winners; in the event any Tier One Prize winner is deemed ineligible, declines, fails to respond to the Notice within the specified time period, refuses and/or fails to provide the required signed Disclaimer and Release Form (“Release Form”), fails to answer the Skill Testing Question correctly, or is not available to participate in the Prize. The Promoter, at its sole discretion, may randomly select more alternate winners in place of the initial potential winners based upon the remaining non-winning, eligible entries; or in its discretion, deem the Prize(s) as finally forfeited. In said case, the Promoter shall have no further liability in connection to this Promotion.

5. TERMS APPLICABLE TO ALL ELEMENTS OF THE PROMOTION AND ALL PRIZES

a) Entrants must accept the Prizes as awarded and cannot elect any other alternatives to any of the Prizes in whole or in part.

b) Prizes are not transferable or exchangeable. No substitutions except at Promoter’s sole discretion. Promoter reserves the right, in its sole and absolute discretion, to substitute the Prize or a component thereof with a prize of equal or greater retail value. Promoter makes no representations or warranties with respect to any Prize.

c) It is the responsibility of the entrant to provide their correct, up-to-date details when entering the Promotion and/or confirming acceptance of the prize in order for their prize to be processed. Entrants who fail to supply accurate information may not be eligible to accept a Prize in the sole discretion of Promoter.

d) The Promoter will not be responsible for lost or stolen Prizes.

e) No entries submitted via any other means than the means described in these Terms will be valid. The Promoter does not guarantee uninterrupted or secure access to the Promotion or the websites on or through which the Promotion is available. Any mechanical reproduction or automated entries are prohibited, and any use of such automated devices will result in the disqualification of the entry and entrant.

f) No additional prizes, at any Tier, will be awarded. Once the Prizes have been awarded, no further prizes will be provided, subject to the discretion of the Promoter.

g) The Promoter reserves the right to verify all entries and to refuse to award a Prize and/or refuse further participation and disqualify any entrant where there are grounds to believe there has been a breach of these Terms or any instructions forming part of the entry requirements or otherwise where an entrant has entered the Promotion using fraudulent means. The Promoter will be the final arbiter in any decisions, and these will be binding.

h) In the event that the Promotion is not capable of running as planned for reasons including but not limited to tampering, unauthorized intervention, fraud, dishonesty, technical failures, or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right to disqualify any individual who tampers with the entry process or does not comply with these Terms and to cancel, modify or suspend the Promotion or invalidate any affected entries, subject only to the jurisdiction of the Régie in Quebec. An entry must be made personally and directly by the individual entering the Promotion, and entries made through agents or third parties are invalid. Bulk entries from trade, consumer groups or third parties will not be accepted. Incomplete or illegible entries and entries submitted by macros or other automated means and entries which do not satisfy the requirements of these Terms in full for any reason will be disqualified and will not be counted. If it becomes apparent that an entrant is using any computer(s) to circumvent this condition by, for example but not limited to, the use of ‘script’, ‘brute force’, masking their identity by manipulating IP addresses, using identities other than their own or any other automated means in order to increase that entrant’s entries into the Promotion in a way that is not consistent with the Terms, that entrant’s entries will be disqualified and any Prize awarded will be void. Entrants are not permitted to enter using anonymous email services such as, but not limited to, GuerillaMail, Dispostable or Mailinator

i) The Promoter will not be liable for any failure to comply with its obligations or any delay in performing its obligations under these Terms if such failure is caused by an act, omission, event or circumstance that is outside the reasonable control of the Promoter, including, but not limited to, global or regional health crises, weather conditions, fire, flood, strike, hurricane, industrial dispute, war, terrorist activity, hostilities, political unrest, riots, civil commotion, epidemic, pandemic, famine, plague or other natural calamities and acts of God, or any other circumstances beyond the reasonable control of the Promoter.

j) The Promoter may refuse to award a Prize in the event of any entrant’s fraud, dishonesty, breach or non-entitlement under these Terms or seek recovery of its value if the Prize has been awarded.

k) The decision of the Promoter in all matters is final and binding and no correspondence will be entered into other than as elected by the Promoter in its sole discretion. ANYONE DEEMED BY THE PROMOTER TO BE IN VIOLATION OF THESE TERMS FOR ANY REASON IS SUBJECT TO DISQUALIFICATION IN THE SOLE AND ABSOLUTE DISCRETION OF THE PROMOTER AT ANY TIME.

l) The Promoter is not responsible for any third-party acts or omissions.

m) The Promoter does not guarantee that the Promotion will be free from disruptions, failings or cancellations. The Promoter is not liable for such disruptions, failings or cancellations. Without limiting the foregoing, the Promoter will have no responsibility for any entries not received or not considered eligible due to any failure or technical malfunction of any computer or telephone networks, online computer systems, servers, access providers, computer equipment or software, photographic equipment or software, technical problems or traffic congestion on the Internet or the promotional website, or any combination thereof. The Promoter will have no responsibility for errors, omissions, interruptions, suppressions, defects, operation or transmission delays or breakdowns in communication links or their unauthorized access or modification.

n) The Promoter will not be liable for any failure to comply with its obligations or any delay in performing its obligations under these Terms . The Promoter reserves the right to cancel or amend this promotion at any time for any reason, subject only to the jurisdiction of the Régie in Quebec.

o) All costs associated with receiving or redeeming any of the Prizes (or any parts thereof) are the sole responsibility of the applicable entrant. All taxes (including without limitation national provincial & local taxes) in connection with any Prize and the reporting consequence thereof are the sole responsibility of the prize winner.

p) All intellectual property, including but not limited to the trademarks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, slogans and other works of authorship used, reproduced or disseminated in connection with the Promotion are owned or used under license by the Promoter and/or the Releasees. All rights are reserved. Unauthorized copying or use of any copyrighted material or other intellectual property by an entrant without the express written consent of Promoter and/or the Releasees, as applicable, is strictly prohibited.

q) All winners assume any and all liability for any injury or damage caused, or claimed to be caused, by entering, participating in this Promotion or the use or redemption of a Prize. By participating in the Promotion and/or accepting a Prize, entrants/winners agree to discharge, release and hold harmless the Promoter, and each of their respective parents, subsidiaries, affiliates, advertising and promotion agencies, other companies associated with the Promotion, and each of their respective officers, directors, employees, shareholders, representatives, and agents (collectively, the “Released Parties”) from and against any claim, liability or cause of action, including but not limited to copyright or intellectual property infringement, loss, damages, injury, or death arising out of participation in the Promotion or receipt or use of a Prize (including any travel or activity related thereto), including, but not limited to: (a) any technical errors associated with the Promotion, including lost, interrupted or unavailable Internet Service Provider (ISP), network, server, wireless service provider, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone, cellular tower or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; (b) human error or unauthorized human intervention in the Promotion; (c) mechanical, network, electronic, computer, human, printing or typographical errors; (d) application downloads, any other errors or problems in connection with the Promotion, including, without limitation, errors that may occur in the administration of the Promotion, the announcement of the winners, the cancellation or postponements of the event and/or the flyover, if applicable, the incorrect downloading of the application, processing of entries application downloads or in any Promotion-related materials; or (f) injury, death, losses, sickness, or damages of any kind, to persons or property which may be caused, directly or indirectly, in whole or in part, from entrants participation in the Promotion or acceptance, receipt or misuse of the prize (including any travel or activity related thereto). Entrant further agrees that in any cause of action, the Released Parties liability will be limited to the cost of entering and participating in the Promotion, and in no event, shall the entrant be entitled to receive attorney’s fees. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Promotion. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

r) The Promotion is subject to applicable federal, provincial and territorial laws and regulations. The Terms are subject to change without notice in order to comply with any applicable federal, provincial and territorial laws or the policy of any other entity having jurisdiction over the Promotion. All issues and questions concerning the construction, validity, interpretation and enforceability of the Terms or the rights and obligations as between a participant and the Promoter in connection with the Promotion shall be governed by and construed in accordance with the laws of the Province of Ontario, including procedural provisions, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws. The Promoter and each entrant irrevocably agree to submit to the exclusive jurisdiction of the courts of the Province of Ontario over any claim or matter arising under or in connection with these Terms or the legal relationships established by this agreement. The invalidity or unenforceability of any provision of these Terms shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Terms shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

s) In the event of any discrepancy or inconsistency between these English Terms and disclosures or other statements contained in any Promotion-related materials, including but not limited to the Promotion entry form, any advertising (whether point-of-sale, television, radio, print or online) or any French version of these Terms, these English Terms shall prevail, govern and control.

t) For Quebec residents: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
